1. About Appeal Specialists

Appeal Specialists ("we", "us", "our") is an independent legal consultancy providing administrative appeals management, document drafting services, and strategic litigation support for parking charges, Penalty Charge Notices (PCNs), and motoring offences.

We are not a regulated law firm. We are not regulated by the Solicitors Regulation Authority (SRA), the Bar Standards Board (BSB), or any other approved legal services regulator. We do not provide "reserved legal activities" as defined by the Legal Services Act 2007. Use of our services does not create a solicitor-client relationship.

2. Services Provided & Exclusions

2.1 Scope of Administrative Services

Our core services operate on a fixed-fee basis and are strictly limited to the provision of administrative dispute resolution, including:

  • Initial merits assessment and strategic review of statutory notices
  • Rigorous compliance audits against applicable legislation (e.g., Protection of Freedoms Act 2012, Road Traffic Offenders Act 1988) and Codes of Practice
  • Drafting formal representations and statutory declarations to issuing operators, local authorities, and police forces
  • Preparation and submission of tribunal appeal bundles to Alternative Dispute Resolution (ADR) bodies including POPLA, IAS, London Tribunals, and the Traffic Penalty Tribunal

2.2 Excluded Reserved Legal Activities

Appeal Specialists expressly excludes the provision of any "reserved legal activity" under the Legal Services Act 2007. We do not and cannot:

  • Conduct litigation (issuing, commencing, prosecuting, or defending formal court proceedings)
  • Exercise rights of audience before any court of law in England and Wales
  • Administer oaths or undertake reserved instrument activities

3. Fees, Payments & Refunds

3.1 Fixed-Fee Engagement

Our administrative services are provided on a fixed-fee basis, payable in advance. This fee covers the full scope of administrative appeal management. It does not cover disbursements or court fees.

3.2 Right to Cancel and Express Request for Immediate Performance

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory right to cancel your contract with us within 14 days without giving any reason, known as the "cooling-off period".

However, because parking appeals are highly time-critical, you may expressly request that we begin providing our services before the end of the 14-day cancellation period. By instructing Appeal Specialists via our submission form, you make an express request for us to commence work immediately.

Acknowledgment of Loss of Cancellation Right: You acknowledge that once we have fully performed the service (e.g., conducted the audit and drafted the representations), you will lose your statutory right to cancel the contract, and the fixed fee will be non-refundable. If you cancel before the service has been fully performed, you will be liable to pay for the work completed up to the point of cancellation.

To exercise your right to cancel (if the service is not yet fully performed), you must inform us of your decision by a clear statement (e.g. an email to legal@appealspecialists.co.uk). You may use the following model cancellation form, although it is not obligatory:

To: Appeal Specialists
I/We [*] hereby give notice that I/We [*] cancel my/our [*] contract for the supply of the following service: [Case Reference / PCN Number],
Ordered on [*],
Name of consumer(s),
Address of consumer(s),
Date

4. No Guarantee of Outcome

Appeal Specialists makes no representations, warranties, or guarantees regarding the outcome of any appeal, representation, or legal challenge. The resolution of any dispute relies upon the subjective determinations of independent adjudicators, tribunals, and issuing authorities over which we exert no control.

We provide our assessment based on current case law and statutory frameworks; however, this does not constitute a guarantee of success. We reserve the absolute right to decline representation where we assess a case to lack reasonable legal merit.

5. Client Warranties & Obligations

By engaging our services, the Client warrants and undertakes to:

  • Provide fully accurate, truthful, and exhaustive information regarding the notice and the factual circumstances of the alleged event
  • Promptly supply any documentation or evidence requested by us within the stipulated deadlines
  • Not conceal, withhold, or misrepresent any material facts
  • Forward any correspondence, court papers, Letters of Claim, summonses, or enforcement notices to us immediately upon receipt

Failure to adhere to these obligations constitutes a material breach of these Terms, entitling Appeal Specialists to terminate the engagement immediately without refund.

6. Strict Limitation of Liability

6.1 Maximum Liability

To the maximum extent permitted by applicable law, the aggregate liability of Appeal Specialists (including its directors, employees, and agents) for any claims arising out of or in connection with the provision of our services - whether in contract, tort (including negligence), breach of statutory duty, or otherwise - shall be strictly limited to the total fixed fee paid by the Client to Appeal Specialists for the specific case in question.

6.2 Excluded Losses

Under no circumstances shall Appeal Specialists be liable for any:

  • Indirect, consequential, special, or punitive damages
  • Loss of profits, loss of business, loss of earnings, or business interruption
  • Escalated fines, additional parking charges, court fees, or debt recovery fees resulting from an unsuccessful appeal
  • County Court Judgments (CCJs) entered against the Client
  • Imposition of driving licence penalty points, driving disqualifications, or criminal convictions
  • Losses arising directly or indirectly from the Client's failure to provide accurate information or adhere to statutory deadlines

6.3 Non-Excludable Liability

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully limited or excluded under the laws of England and Wales.

7. Indemnification

The Client agrees to fully indemnify, defend, and hold harmless Appeal Specialists, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) that arise from or relate to the Client's breach of these Terms, the Client's provision of false or misleading information, or the Client's failure to respond to court or enforcement correspondence.

8. Force Majeure

Appeal Specialists shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause that is beyond our reasonable control, including but not limited to cyber-attacks, server outages, postal strikes, pandemic restrictions, or acts of God.

9. Severability

If any provision or part-provision of these Terms is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any modification to or deletion of a provision shall not affect the validity and enforceability of the rest of these Terms.

10. Governing Law & Jurisdiction

These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter, shall be governed by and construed strictly in accordance with the laws of England and Wales.

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the services provided.

11. Complaints Procedure

We are committed to providing a high-quality service. If you are dissatisfied with any aspect of our service, please contact us at legal@appealspecialists.co.uk outlining the nature of your complaint. We will acknowledge your complaint within 3 working days and aim to provide a full substantive response within 14 working days.

12. Professional Indemnity Insurance

In accordance with the Provision of Services Regulations 2009, details of our Professional Indemnity Insurance, including the contact details of our insurer and the territorial coverage of the policy, are available to clients upon written request.

13. Entire Agreement

These Terms constitute the entire agreement between the Client and Appeal Specialists regarding the provision of our services, superseding all prior discussions, correspondence, representations, or understandings.
