Our Expertise

Deep, specialist knowledge of UK parking enforcement law, motoring offence procedure, and tribunal advocacy.

Who We Are

Appeal Specialists is a UK-based legal consultancy established to provide motorists and vehicle keepers with expert-level representation in parking ticket appeals and motoring offence challenges. We operate as authorised representatives - drafting administrative appeals, preparing tribunal bundles, and managing the entire appeals process from initial assessment to final adjudication.

Our team possesses a forensic understanding of the statutory frameworks, codes of practice, and case law precedents that govern parking enforcement and motoring prosecution in England and Wales.

Statutory Expertise

Protection of Freedoms Act 2012

Schedule 4 of the POFA establishes the strict procedural framework for private parking charge recovery. We exploit every failure: defective Notices to Keeper, missed statutory timescales, absent prescribed information, and non-compliant service methods. If the operator has failed to adhere to Schedule 4, the keeper liability mechanism collapses entirely.

BPA & IPC Codes of Practice

All accredited parking operators must comply with either the British Parking Association (BPA) or International Parking Community (IPC) Codes of Practice. We audit every charge against the relevant code - examining signage adequacy, grace period compliance, consideration period requirements, and whether the charge level falls within the code's prescribed maximum.

ParkingEye v Beavis [2015] UKSC 67

While the Supreme Court upheld the enforceability of proportionate parking charges, the judgment simultaneously reinforced critical requirements: signage must be clear and prominent, the charge must not be extravagant or unconscionable, and the operator must demonstrate a legitimate interest. We identify cases where operators fail these tests.

Road Traffic Offenders Act 1988

Section 1 of the RTOA mandates that a Notice of Intended Prosecution (NIP) must be served on the registered keeper within 14 days of the alleged offence. This is an absolute statutory requirement - failure to serve within the prescribed period renders the prosecution invalid. We request proof of timely service in every case.

Areas of Deep Knowledge

Contract Law

Formation, consideration, privity, and the enforceability of terms displayed at car parks. We challenge whether a valid contract existed at the time of the alleged parking event.

📄

ANPR & Evidence

Automatic Number Plate Recognition systems are fallible. We challenge timestamp accuracy, camera calibration, partial misreads, and failures in the evidential chain of ANPR data.

📊

Speed Detection

We demand Home Office Type Approval certificates, calibration records, and maintenance logs for all speed detection equipment - from Gatso cameras to mobile laser devices.

About Our Status: Appeal Specialists is a specialist legal consultancy providing administrative appeals management and document drafting services. We are not a law firm.
